Terms and Conditions for GotBack.app

1. Agreement to these terms

These Terms and Conditions govern your access to and use of GotBack.app, a Bootstrap Bots product, including related websites, forms, intake flows, phone/text workflows, support communication, and any services made available through GotBack.app.

By using the website, submitting information, opting in to messaging, or using the services, you agree to these Terms. If you use GotBack.app on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Service overview

GotBack.app helps businesses manage customer communication, website and Google profile information, phone and SMS intake, reminders, routing, owner approvals, customer records, job context, and related workflow support.

Services may include website setup, business information intake, phone/text configuration, customer intake workflows, support communication, reminders, content updates, Google profile coordination, and other operational services described on the website or in an applicable order, proposal, or plan.

3. Accounts, onboarding, and authority

You are responsible for providing accurate onboarding information, business details, service descriptions, hours, prices, emergency rules, team instructions, customer communication preferences, and other materials needed to configure the service.

You are responsible for making sure you have the rights and permissions needed to provide any logos, photos, customer information, phone numbers, website access, Google profile access, and other business materials you submit to GotBack.app.

4. Customer communication and owner approvals

GotBack.app may help draft, route, summarize, or send communication based on the instructions and approval paths you provide. You remain responsible for the accuracy of business information, customer-facing promises, pricing, emergency instructions, scheduling commitments, legal requirements, and any messages approved by you or your authorized users.

Some workflows may require owner review before a message, update, or response is sent. If you delay, reject, or fail to review a requested approval, related customer communication or business updates may also be delayed.

5. SMS program consent

By providing your mobile phone number and affirmatively opting in, you agree to receive SMS messages from Bootstrap Bots and GotBack.app. Consent is not a condition of purchase.

Messages may include onboarding messages, setup links, support follow-ups, workflow status notifications, account-related messages, customer intake prompts, reminders, verification messages, and service-related communication. Public keyword-based consent details are published on the SMS Opt-In page.

6. Message frequency, rates, and opt-out

Message frequency varies based on your activity, service setup, account events, support needs, and workflow activity. Message and data rates may apply depending on your mobile carrier plan.

You can opt out of SMS messages at any time by replying STOP. For help, reply HELP. We may send one final message confirming your opt-out. After that, we will stop sending non-exempt SMS messages unless you opt in again.

7. Acceptable use

You agree not to use GotBack.app to:

• Send unlawful, fraudulent, deceptive, abusive, harassing, or misleading communication
• Send messages without proper consent or authorization
• Impersonate another person or business
• Submit information you do not have the right to use
• Interfere with the security, availability, or integrity of the website or services
• Use the service for prohibited content, illegal products, or activity that violates carrier or platform rules
• Attempt to reverse engineer, scrape, overload, or misuse any part of the service

8. Business content and customer data

You retain ownership of the business materials, customer information, photos, instructions, and other content you provide. You grant Bootstrap Bots and GotBack.app permission to use that content as needed to provide, operate, support, improve, and document the services.

You are responsible for the legality, accuracy, quality, and appropriateness of customer data and business content you provide or authorize us to process.

9. Third-party services

GotBack.app may rely on third-party tools and platforms for hosting, messaging, phone numbers, analytics, databases, payment processing, website services, Google profile support, and other operational functions. Your use of those services may also be subject to the terms, policies, and availability of those third parties.

We are not responsible for outages, delays, policy changes, number filtering, carrier decisions, platform restrictions, or other issues caused by third-party providers.

10. Plans, fees, and payment

Fees, billing intervals, included services, usage limits, and cancellation terms may be described on the website, in a plan, proposal, order form, invoice, or other written agreement. You agree to pay applicable fees when due.

Unless otherwise stated in a separate written agreement, fees may be non-refundable once work has started, setup has begun, a subscription period has started, or third-party costs have been incurred.

11. No professional advice

GotBack.app provides communication, website, workflow, and operational support. We do not provide legal, tax, accounting, insurance, emergency, safety, medical, or professional advice. You are responsible for obtaining professional advice where appropriate for your business.

12. Intellectual property

Bootstrap Bots and GotBack.app retain ownership of their websites, software, workflows, designs, templates, processes, names, marks, and other intellectual property. You may not copy, resell, or create derivative products from the service except as allowed in writing.

Subject to your compliance with these Terms and payment of applicable fees, you may use deliverables provided to your business for your own business operations.

13. Service availability and changes

We may modify, suspend, improve, limit, or discontinue parts of the website or services at any time. We work to keep the service reliable, but we do not guarantee uninterrupted access, error-free operation, or that every message, call, reminder, or update will be delivered without delay.

14. Disclaimers

The website and services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation.

15. Limitation of liability

To the fullest extent permitted by law, Bootstrap Bots and GotBack.app will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business, missed messages, missed calls, delayed communication, or reputational harm.

To the fullest extent permitted by law, our total liability for any claim related to the website or services will not exceed the amount you paid to us for the service giving rise to the claim during the three months before the event giving rise to the claim.

16. Indemnification

You agree to defend, indemnify, and hold harmless Bootstrap Bots, GotBack.app, and their owners, contractors, providers, and representatives from claims, damages, liabilities, costs, and expenses arising from your content, customer data, instructions, approvals, use of the services, violation of these Terms, or violation of law or third-party rights.

17. Suspension and termination

We may suspend or terminate access to the website or services if you violate these Terms, fail to pay amounts due, misuse the service, create security or compliance risk, or use the service in a way that may harm users, customers, carriers, platforms, or our business.

18. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Venue for disputes will be in state or federal courts located in Pennsylvania unless otherwise required by applicable law.

19. Changes to these terms

We may update these Terms from time to time. Updated terms will be posted on this page with a revised effective date. Your continued use of the website or services after an update means the updated Terms apply going forward.
